Applicant:
1. You must be 18 years old or older.
2. You must meet the health and character requirements.
3. You must have an eligible sponsor.
4. You must currently hold a temporary Partner subclass 309 visa.
5. You must provide sufficient evidence to demonstrate your continuing relationship with your sponsoring partner.
6. You have not been involved in any illegal business or investment.

Sponsor:
1. The sponsor cannot sponsor more than 2 people as their spouse, de facto partner or prospective spouse on the basis of a sponsorship or nomination in their lifetime. The two sponsorships must be at least 5 years apart.
2. If the sponsor was themselves sponsored for a Partner visa, more than 5 years must have elapsed since their own visa was lodged.
3. The holder of a subclass 204 Woman at Risk visa is prevented from sponsoring a partner within the 5 years immediately preceding the application.
4. The sponsor must not have been charged or convicted of offences involving children.

Criteria for Subclass 100 visa:
1. You can lodge the application for this visa from inside Australia two years after your temporary Partner Subclass 309 visa is lodged.
2. The relationship between you and your sponsoring partner is genuine and continuing.
3. You may be granted a subclass 309 and 100 visa at the same time if your partner relationship with your sponsoring partner is not less than 3 years or if there is a dependent child of both you and your partner. The application must be lodged while you are outside Australia.
