Suitable for
1. Be in a genuine relationship with an eligible Australian citizen, Australian permanent resident or eligible New Zealand citizen.
2. Intend to marry the prospective spouse within 9 months from date of grant of visa.

 


Introduce

If you have a prospective spouse who is eligible to sponsor you, and you and your spouse are in a genuine relationship which could be supported by sufficient evidence, you can apply for a Prospective Marriage subclass 300 visa from outside Australia. You also need to meet the health and character requirements.
You can obtain permanent residency by applying for subclass 820/801 visa in Australia before your subclass 300 visa ends.

 

 

 


Condition

Applicant:
1. You must be 18 years old or older.
2. You must meet the health and character requirement.
3. You must have an eligible sponsor.
4. You must provide sufficient evidence to demonstrate your relationship with your sponsoring partner.
5. You have not been involved in any illegal business or investment.

Sponsor:
1. The sponsor cannot sponsor more than 2 people as their spouse, de facto partner or prospective spouse on the basis of a sponsorship or nomination in their lifetime. 2. The two sponsorships must be at least 5 years apart.
3. If the sponsor was themselves sponsored for a Partner visa, more than 5 years must have elapsed since their own visa was lodged.
4. The holder of a subclass 204 Woman at Risk visa is prohibited from sponsoring a partner within the 5 years immediately preceding the application.
5. The sponsor must not have been charged or convicted of offences involving children.
 
Notes:
1. If you get married with your prospective spouse after you lodge your application for a subclass 300 visa but before a decision has been made, you can send a request to the Immigration Department to be considered for a Partner visa.
2. There is no requirements about where you can marry your prospective spouse, but you must enter Australia at least once after you are granted the subclass 300 visa.
3. The subclass 300 visa permits you to travel to, enter and remain in Australia for 9 months from date of grant, and you must marry your prospective spouse before your visa expires.
