Suitable for:
1. Dependent child of a parent who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
2. Be under 18 years, or a full-time student aged over 18 and under 25.
3. Be single.
4. Be inside Australia when the application is lodged and when a decision on the application is made. If you are outside Australia, you could choose to apply for the offshore Child subclass 101 visa.



Introduce

The onshore permanent Child Subclass 802 visa lets a biological child, adopted child or stepchild of an Australian citizen, Australian permanent resident or eligible New Zealand citizen move to live with their parents in Australia permanently. If the child is over 18 and under 25 years, they must be a full-time student and financially dependent on the parent.

Condition

Applicant (the child):
1. You must be under 18 years, a full-time student aged over 18 and under 25 and financially dependent on the parent, or over 18 and unable to work due to a disability.
2. You can be your parent’s biological child, adopted child or stepchild, but:
A. If you are an adopted child, the adoption must have been finalised before you turn 18.
B. If you are a stepchild,
- you must be aged under 18 at the time of application;
- you must be the child of your step-parent’s former partner;
- your step-parent must have an Australian parenting order in force that says the child is to live with them and be looked after by them, or guardianship or custody of the child under an Australian law or the law of another country.
3. You must be single;
4. You must meet health and character requirements.

Sponsor (the parent):
1. The sponsor must be an Australian citizen or eligible New Zealand citizen, or hold an Australian permanent visa, and must have no criminal record.
2. The sponsor must be the child’s biological parent, step parent or adoptive parent.
3. The child visa will only be granted to a child younger than 18 years if either:
- the laws of the child’s home country allow them to leave their home country, or
- the child have the written consent of everyone who can legally decide where they live, or
- it is consistent with Australian Family Law Act and any Australian child order about the child
4. You can sponsor an adopted child for this visa if either
- the child was adopted in line with the Adoption Convention and you have an adoption compliance certificate for them, or
- you became an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen before or after you adopted the child with approval from an Australian state or territory authority, or
- if the adoption was an expatriate adoption after you became an Australian citizen or an Australian permanent resident, you do not meet the criteria for the subclass 802 visa and you may apply for the offshore Adoption Subclass 102 visa.
