Applicant (the child):
1. You must be under 18 years, a full-time student aged over 18 and under 25 and financially dependent on the parent, or over 18 and unable to work due to a disability.
2. You can be your parent’s biological child, adopted child or stepchild, but:
A. If you are an adopted child,
- you must have been adopted before you turned 18 by a parent who was not an Australian citizen, Australian permanent resident or eligible New Zealand citizen at the time of adoption;
- if you are adopted before you turned 18 by a parent who was already an Australian citizen, permanent visa holder or eligible New Zealand citizen at the time of adoption, you could apply for an Adoption Subclass 102 visa;
- you must be adopted when you are less than 18.
B. If you are a stepchild,
- you must be aged under 18 at the time of application;
- you must be the child of your step-parent’s former partner;
- your step-parent must have an Australian parenting order in force that says the child is to live with them and be looked after by them, or guardianship or custody of the child under an Australian law or the law of another country.
3. You must be single.
4. You must meet health and character requirement.
Sponsor (the parent):
1. The sponsor must be an Australian citizen or eligible New Zealand citizen, or hold an Australian permanent visa, and must have no criminal record.
2. The sponsor must be the child’s biological parent, step parent or adoptive parent.
3. The child visa will only be granted to a child younger than 18 years if either:
- the laws of the child’s home country allow them to leave their home country, or
- the child has the written consent of everyone who can legally decide where they live, or
- it is consistent with Australian Family Law Act and any Australian child order about the child.
